By making a reservation, using our website or staying at Ao Thai Resort and Restaurant Co., Ltd., the guest agrees to these Terms and Conditions.
1. Prices and Taxes
All prices are displayed in Thai Baht (THB), unless otherwise stated. Prices include applicable taxes and service charges as clearly indicated at the time of booking.
The Hotel reserves the right to correct obvious pricing errors. If a price has been displayed incorrectly, the Hotel will inform the Guest as soon as reasonably possible and offer the option to confirm the reservation at the correct price or cancel the reservation without cancellation charges.
Additional charges may apply for extra guests, extra beds, meals, transfers, special requests, minibar consumption, damage, loss or other services not included in the booked rate.
2. Payment and Terms at Check-in/Check-out
A valid credit card or other accepted payment method may be required to guarantee a reservation. The Hotel may pre-authorize or charge the applicable amount in accordance with the selected rate and cancellation policy.
At check-in, the Guest must present a valid passport or other legally acceptable identification document. Thai residents may be required to present a valid Thai national identification card or other accepted identification.
The Hotel may request a security deposit or card pre-authorization at check-in. The deposit will be returned, or the pre-authorization released, after check-out, subject to any outstanding charges, damage, loss or other amounts owed to the Hotel. Processing times may depend on the Guest’s bank or card issuer.
The standard check-in time is 2pm and the standard check-out time is 12pm, unless otherwise confirmed. Early check-in and late check-out are subject to availability and may incur additional charges.
All outstanding charges must be settled at or before check-out. If payment is declined or remains unpaid, the Hotel may charge the payment method provided, where legally permitted.
3. Cancellations and No-shows
Reservations are subject to the cancellation and payment conditions displayed during the booking process and stated in the booking confirmation.
If the Guest cancels within the applicable restricted period, fails to arrive or shortens the stay, cancellation or no-show charges may apply. These charges will depend on the selected rate, booking channel and applicable terms.
For reservations made through an online travel agency or other third party, the cancellation conditions of that provider may also apply.
4. Traveling with Minors
Children and minors must be accompanied by a parent, legal guardian or another responsible adult, unless otherwise agreed in writing by the Hotel.
The Guest is responsible for supervising all minors in the Hotel, including in swimming pools, restaurants, public areas and other facilities. The Hotel may request identification or documents confirming the relationship or authority of the accompanying adult where reasonably necessary.
Children’s breakfast, extra-bed, cot and other charges are subject to the conditions shown at the time of booking. Age limits and child policies may vary according to the room type and rate selected.
5. Accessibility or Special Needs
The Hotel will make reasonable efforts to accommodate accessibility requirements and special requests, subject to the Hotel’s facilities, availability and applicable safety requirements.
Guests should contact the Hotel before booking or as soon as possible after booking to discuss mobility assistance, accessible rooms, medical equipment, dietary requirements or other needs.
A special request is not guaranteed unless the Hotel confirms it in writing. The Hotel may offer an alternative arrangement if the requested facility or service is unavailable.
6. Parking
Parking is subject to availability and is provided free of charge.
The Guest must follow all parking instructions and park only in designated areas. Vehicles and their contents are left at the Guest’s risk, except where liability cannot legally be excluded.
The Hotel is not responsible for loss of or damage to vehicles caused by theft, weather, third parties or other circumstances beyond the Hotel’s reasonable control, except to the extent required by applicable law.
7. Hotel Events
The Hotel may host weddings, conferences, parties, live entertainment or other events. Guests may experience reasonable noise, changes to access routes, temporary closures or increased activity during such events.
The Hotel will make reasonable efforts to notify affected Guests where practicable. Event arrangements may change because of operational, safety, weather or legal requirements.
The Hotel may restrict access to certain areas during an event and may apply additional security or safety procedures.
8. Guest Conduct and Hotel Rules
Guests must behave respectfully and comply with Hotel rules, safety instructions and applicable laws in Thailand.
The Hotel may refuse service, restrict access or terminate a stay without refund where a Guest behaves abusively, threatens staff or other guests, causes serious disturbance, engages in unlawful conduct or creates a safety risk.
Smoking, vaping, cooking, pets, parties and the use of additional occupants are permitted only where expressly allowed by the Hotel. Charges may apply for violations, including cleaning, odor removal, damage or loss of revenue.
9. Dispute Resolution and Issues
Guests should report any problem, defect or complaint to the front desk or Hotel management as soon as reasonably possible so that the Hotel has an opportunity to investigate and remedy the issue during the stay.
The Hotel will review complaints fairly and make reasonable efforts to resolve them promptly. Guests are requested to provide relevant details, receipts, photographs or other supporting information where appropriate.
Nothing in these Terms limits any mandatory rights or remedies available to the Guest under applicable Thai law.
10. Use of Personal Information
The Hotel collects, uses, stores and discloses personal information for purposes including reservations, check-in, payment processing, guest services, safety, legal and regulatory compliance, fraud prevention and communication regarding the Guest’s stay.
Personal information may be shared with service providers and third parties such as booking platforms, payment processors, IT providers, transport providers, insurers, government authorities and emergency services, where necessary and legally permitted.
The Hotel processes personal information in accordance with Thailand’s Personal Data Protection Act B.E. 2562 (2019) and its Privacy Notice. The Privacy Notice explains the categories of data collected, purposes, retention periods, recipients and the rights available to data subjects.

11. Liability
The Hotel will provide its services with reasonable care and skill. Nothing in these Terms excludes or limits liability for matters that cannot lawfully be excluded or limited under Thai law.
Subject to applicable law, the Hotel is not responsible for loss, damage, delay or expense resulting from the Guest’s own acts or omissions, failure to follow Hotel instructions, or circumstances outside the Hotel’s reasonable control.
Guests are responsible for the safety and security of their personal belongings. Valuables should be stored in the room safe or deposited with the Hotel where such service is available.
The Guest is responsible for damage to Hotel property, facilities or equipment caused by the Guest, accompanying persons or visitors, except for ordinary wear and tear.
12. Force Majeure
The Hotel will not be liable for failure, delay or interruption in providing services caused by events beyond its reasonable control. Such events may include natural disasters, severe weather, floods, fire, epidemic or pandemic, government action, changes in law, war, terrorism, civil unrest, strikes, power or telecommunications failure, transport disruption or other comparable events.
The Hotel will make reasonable efforts to notify affected Guests and reduce the effects of such an event. Where possible, the Hotel may offer alternative dates, a credit or another reasonable solution, subject to the circumstances and applicable law.
13. Third-Party Rights
These Terms create rights and obligations between the Guest and the Hotel. Unless expressly stated otherwise or required by law, no person who is not a party to the reservation may enforce any provision of these Terms.
Services supplied by third parties, including transport, tours, restaurants, booking platforms and payment providers, may be subject to their own terms and conditions.
14. Waiver
If the Hotel does not immediately enforce a right or provision under these Terms, this does not mean that the Hotel has waived that right or provision.
Any waiver must be expressly given in writing by an authorized representative of the Hotel.
15. Severance
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or removed only to the extent necessary.
The remaining provisions will continue in full force and effect.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Thailand.
Subject to any mandatory rights of the Guest, disputes shall be submitted to the courts of Thailand having appropriate jurisdiction, preferably the courts in or closest to Songkhla, Thailand.
